Terms & Conditions of TNG Mastercard
By accepting, signing on or using the TNG Mastercard Prepaid Card issued by TNG (Asia) Limited (“TNG”) (“TNG Mastercard”), you agree to be bound by the terms and conditions below as amended from time to time (the “Terms and Conditions”). “You”, “your” and “cardholder” refer to the person who has applied and used the TNG Mastercard. “We”, “us” and “our” refer to TNG.
Please read the Terms and Conditions below carefully before activating or using the TNG Mastercard. By activating or using the TNG Mastercard, you are deemed to have read, understood and agreed to be bound by the Terms and Conditions.
1.Definitions
“Balance” means the value of the funds that are available at the TNG Mastercard linking the TNG Wallet Account for spending.
“Business Day” means any day other than a Saturday, a Sunday or a public or bank holiday in Hong Kong.
“Card Account” means an account that we have created to record the Balance available and transactions of your TNG Mastercard.
“Hong Kong” means the Hong Kong Special Administrative Region, the People’s Republic of China.
“Mastercard Acceptance Mark” means the brand mark of Mastercard International Incorporated as further described on https://www.mastercardbrandcenter.com and which is used for all TNG Mastercard.
“Mobile Wallet” means such mobile payment platforms installed in your mobile device(s) allowing the storage of digital version of TNG Mastercard;
“TNG Wallet” means the prepaid account at TNG, protected by a pin and/or password and/or any biometric authentication, in which you or the cardholder can store money for any future online transactions.
“TNG Wallet Account” means the e-Wallet account that you have at TNG.
2.TNG Mastercard
Your TNG Mastercard is a general purpose reloadable prepaid card linking your TNG Wallet Account and is neither a non-reloadable gift card nor a credit card, and it can be used at any location that display the Mastercard Acceptance Mark, including point of sale retail merchants, online and offline. You can also use your TNG Mastercard in areas outside Hong Kong, subject to additional fees such as those in connection with currency exchange rate and handling fees.
Before using the TNG Mastercard you need to make sure that it has been activated and that the Balance available is sufficient for your purchase. You will not be able to use your TNG Mastercard when it has been deactivated or expired after its expiry date. Your TNG Mastercard is attached to the Card Account and linking to your TNG Wallet Account.
In order to protect your interests, the amount of funds available at your TNG Mastercard shall link your TNG Wallet Account. Your Balance available shall be equivalent to the funds available at your TNG Wallet Account, unless a limit has been set at your TNG Mastercard, subject to the value-added services as provided by TNG from time to time. We promise that (i) we will not create (or cause to be created) any lien, charge, pledge, encumbrances, equity or any type of third party right on your fund; and (ii) we will properly keep and back up the account details and records associated with your TNG Mastercard. You acknowledge and agree that you will only be able to access the information about your remaining funds in your Card Account or your TNG Wallet Account. The Card Account is operated and maintained under our management system and linked up with your TNG Wallet Account.
There is no minimum Balance requirement in your Card Account, but we may deactivate or cancel your TNG Mastercard at any time regardless of your Balance. Your Card Account is not a deposit account and no interest will be paid on the Balance. The default currency denomination of your Balance will be in Hong Kong dollars.
The TNG Mastercard is and will remain our property and TNG shall have sole discretion to manage, activate or deactivate your Card Account. However, you will be solely and completely responsible for the possession, use and control of the TNG Mastercard (for the avoidance of doubt, including any supplementary card(s)). You must surrender the TNG Mastercard to us immediately upon request. You must not use the TNG Mastercard for any illegal transactions or purposes. You are not allowed to authorize another person to use your own TNG Mastercard but if you do so, you agree, to the extent permitted by law, that you will be liable for all transactions arising from the use of your TNG Mastercard by such person.
3.Requirements / Eligibility
You must be at least eighteen (18) years of age to apply for a TNG Mastercard. You must hold a TNG Wallet Account and agree to link such account with your TNG Mastercard. We will require evidence of your identity, such as an identity card bearing your photograph or a valid international passport incorporating photographic evidence of your identity, issued by a competent governmental authority.
Each cardholder shall be eligible to hold one (1) physical TNG Mastercard and one (1) equivalent virtual card under the same Card Account. Any such card is personal, and shall not be transferrable nor sub-licensable.
The cardholder may apply for supplementary card(s) for any of his or her children under eighteen (18) years of age. We will require evidence of the relationship and child’s identity bearing the child’s photograph such as a birth certificate, a valid identity card or international passport, issued by a competent governmental authority.
TNG may process or accept any application for a TNG Mastercard or its supplementary card in its sole and absolute discretion.
We send any supplementary card(s) and all communications relating to such card(s) to you. Any communication we give to you or any supplementary card holder(s) is taken to be given to all of you. You and each supplementary card holder(s) agree to be bound by the instructions that any of you give us.
4.Limits, Fees and Charges
Subject to the services as provided by TNG from time to time, the TNG Mastercard may be subject to certain limits for spending to be set on a per transaction, daily, weekly, monthly and/or yearly basis. The value-added services if applicable, may be subject to separate terms and conditions, as well as additional fees or charges.
We will not be liable for any losses or expenses incurred by you arising from any spending limits, whether imposed by us or by yourself under any value-added services. You are advised to familiarize yourself with any spending limits imposed by us from time to time and any spending limits pre-set by you under any value-added services in order to avoid inability to use your TNG Mastercard.
5.TNG Mastercard Transactions
To use the TNG Mastercard, simply present the TNG Mastercard at the time of payment, and input your pin and/or password, or sign the receipt (if necessary) with the same signature you used in signing on the TNG Mastercard. You may wish to retain the receipt as a record of the transaction. You must ensure that there is a positive Balance in your TNG Mastercard and TNG Wallet Account before using such TNG Mastercard for any transaction. As you use the TNG Mastercard, your TNG Mastercard’s Balance will be reduced by the full amount of each purchase including taxes, charges and other fees, if any. The TNG Mastercard can be used to pay the full amount of the purchase and applicable taxes, so long as the Balance remaining on the TNG Mastercard linking your TNG Wallet Account is sufficient. You may not make a purchase in an amount that exceeds the remaining Balance.
You agree that we are not required to verify the signature on any sales receipts prepared in connection with a transaction carried out on your TNG Mastercard and we may authorize and process a transaction even if there is no signature, or the signature on the sales receipt is different from the signature on your TNG Mastercard. You do not have any right to stop the payment of any transaction you conduct with the TNG Mastercard. Subject to the limit set on your TNG Mastercard, you may make pre-authorized regular payments through the use of your TNG Mastercard. We are not liable to you for declining authorization for any particular transaction, regardless of any cause. Subject to the value-added services as provided by TNG from time to time, you may be able to set the categories or types of merchants, or its country or domicile, for settling payment by your TNG Mastercard. The value-added services may be subject to separate terms and conditions.
No cash withdrawal shall be made through your TNG Mastercard.
Online transactions must be authorized by you by entering your TNG Mastercard details as requested by the retailer. This usually means providing your TNG Mastercard number, the name on the TNG Mastercard, the expiration date of the TNG Mastercard and in many cases the CVC2 number printed on the back of it. You cannot withdraw your authorization after having completed your transaction.
For all transactions involving currency conversion, the exchange rate refers to the rate applied by Mastercard on the date of conversion. However, if a foreign transaction is refunded to your TNG Mastercard, the Mastercard conversion rate used to convert your refund to Hong Kong dollars for your TNG Mastercard is the rate that we pay to Mastercard minus any possible foreign exchange service charge of the refund. Further, the rate that we pay to Mastercard may not be the same rate as that of the date the transaction was refunded. For these reasons, the amount that is credited to your TNG Mastercard for a refund of a foreign currency transaction will, in most cases, be less than the amount that was originally charged to your TNG Mastercard for that transaction.
You acknowledge that you may have dispute rights pursuant to card association and network rules or otherwise, and we have the rights (but not the obligation) to pass any applicable chargebacks to you under the use of the TNG Mastercard.
Both Mastercard and we have the rights and authority to charge you a reasonable handling fee during the investigation and chargeback process. Please note, Mastercard will only charge the cardholder of the TNG Mastercard through us.
6.Digital version of your TNG Mastercard
You may store a digital version of TNG Mastercard in your Mobile Wallet only if the TNG Mastercard is of a type and/or card scheme designated by us from time to time and is in good standing. You may need to agree to separate terms with the Mobile Wallet provider, which govern the registration and storage of your TNG Mastercard in the Mobile Wallet and the use of the Mobile Wallet (including the use of any data you provide to the Mobile Wallet provider). Those separate terms you agree with the Mobile Wallet provider will not change or override these Terms and Conditions.
You should follow the instructions of the Mobile Wallet provider (including installation of the latest operating system for your mobile device), and the registration and verification flow of your Mobile Wallet in order to register and store your TNG Mastercard in your Mobile Wallet. By registering your TNG Mastercard in your Mobile Wallet, you consent to us sending SMS message to you for verification and activation purpose based on your phone number last recorded with us. If you do not take security measures as we or the Mobile Wallet provider may recommend from time to time, you will bear the risk of suffering or incurring any loss which may arise from or in connection with your TNG Mastercard. We are not liable for any such loss. You should take appropriate security measures including the following:
- take reasonable precautions to keep TNG Mastercard details and security details relating to your TNG Mastercard, Mobile Wallet and mobile device (including your Device Passcode, payment PIN, fingerprint and/or any other biometric credentials stored in your mobile device and/or any cloud storage platform) safe and to prevent loss, theft or fraudulent use of them;
- safeguard your Mobile Wallet and mobile device and keep them under your personal control at all times;
- DO NOT allow anyone else to use or log on to your mobile device and Mobile Wallet;
- ensure that your biometric credentials stored on your mobile device are your own and DO NOT store anyone else's fingerprint or biometric credentials in your mobile device, and that you only use your own biometric credentials to use your Mobile Card or Mobile Wallet;
- DO NOT take any action to disable any function provided by, and/or agreeing to any settings of your mobile device that would compromise the security of the use of your biometric credentials for the use of TNG Mastercard or Mobile Wallet (e.g. disabling “attention-aware” for facial recognition);
- DO NOT choose obvious numbers as Device Passcode or payment PIN (such as Hong Kong Identity Card number, date of birth, telephone number, number with same digits or other that can be easily guessed or identified by shoulder surfing) or tell anyone else your Device Passcode or payment PIN or write down or keep your Device Passcode or payment PIN close to your mobile device;
- DO NOT install or launch Mobile Wallet in a smartphone or other device with any pirated, hacked, fake or unauthorised application or where the software lockdown has been overridden (such as a “jailbroken” or “rooted” smartphone or device);
- change the Device Passcode or payment PIN regularly and use alphanumeric code for Device Passcode or payment PIN (if available);
- if you have already set up access to your mobile device by way of Device Passcode or fingerprint or other biometric credentials, review this and ensure that you change any Device Passcode that can easily be guessed or that has already been shared with anyone else and delete any fingerprint or other biometric credentials that is not your own;
- delete your TNG Mastercard from the Mobile Wallet before you dispose of your mobile device by, for example, selling or giving it to someone else or pass your mobile device temporarily to someone else, for example, for it to be repaired; and/or
- remove the Mobile Credit Card from the Mobile Wallet upon termination of your TNG Mastercard.
You are fully responsible for any disclosure of your details of your TNG Mastercard, device passcode, payment PIN, or other security details relating to your mobile device, Mobile Wallet and TNG Mastercard to any other person, even if such disclosure is accidental or unauthorised. You are required to bear all risks and consequences of your Mobile Wallet and TNG Mastercard being used by unauthorised persons or for unauthorised purposes.
7.Your details
You are required to inform us if you change your name, mailing or home address, telephone number, mobile number or e-mail address within 14 days after the change, and you may be liable for any unauthorized transactions caused by your failure to keep your details accurate and up to date. You shall be responsible if such an incident occurs and we are not liable for any consequences or losses arising from such event. We will send information to the latest updated registered address or contact we have of you.
8.Cancellation or suspension of TNG Mastercard
You may terminate or cancel your TNG Mastercard and Card Account at any time by contacting TNG at +852 3951-6268. Termination / cancellation of your TNG Mastercard requested by you gives you a right to a refund once the request is processed or accepted by us. We will cancel your TNG Mastercard after receiving your request.
You may also temporarily suspend, and subsequently resume, your TNG Mastercard following subscription of our value-added services at the mobile App of your TNG Wallet.
We shall have the right to suspend or terminate your TNG Mastercard and/or your Card Account at any time at our discretion without prior notice and without assigning any reason. Without prejudice to the generality of the foregoing, we shall be entitled to terminate your TNG Mastercard or your Card Account immediately without notice if you commit any breach of or omit to observe any obligation under these Terms and Conditions (or any terms and conditions for the value-added services, if applicable), which in our opinions, amounts to a material default on your part or if we suspect any actual or potential fraud or illegal activity through your TNG Mastercard, Card Account and/or TNG Wallet Account.
If the Balance of your TNG Wallet Account is zero, we may, without prejudice to the generality of the foregoing, suspend your TNG Mastercard and/or Card Account without notice.
TNG reserves its right to suspend or deactivate any TNG Mastercard if there is no record of activity for the TNG Mastercard for a period of ninety (90) days, and you have to contact TNG at +852 3951-6268 or through its value-added services to re-activate your Mastercard.
Any value-added services to be provided by TNG may be subject to additional fees or charges.
9.Complaint Handling
You may contact TNG at +852 3951-6268 for any enquiry or complaint that you may have in relation to TNG Mastercard.
TNG reserves its right to handle, settle or adjudicate any enquiry or complaint as it thinks fit, and in compliance with the local laws and regulations.
10.Loss, theft or misuse
You must tell us TNG at +852 3951-6268 or visit the TNG website https://support.tng.asia/en/rlt straight away if you notice or suspect any loss, theft, unauthorised possession, control or use of your TNG Mastercard or mobile device, or if you believe someone else has used your TNG Mastercard or mobile device, or has discovered the security details of your mobile device, TNG Wallet or TNG Mastercard or the security of your TNG Wallet or TNG Mastercard or mobile device has been compromised in any other manner.
You will be liable for all unauthorised TNG Mastercard transactions effected by your TNG Mastercard before we receive any report of loss, theft, disclosure or unauthorised use of your TNG Mastercard.
Your failure to follow any of the security measures recommended by us from time to time regarding the use or safekeeping of your Mobile Wallet, Mobile Credit Card or mobile device may be treated as your gross negligence
We reserve the right to charge you for the issuance of a new TNG Mastercard.
11.Your Liability
You are liable for:
- any of your failure to comply with the Terms and Conditions, or any terms and conditions for the value-added services, if applicable;
- any transactions where we could otherwise have exercised chargeback rights if you do not notify us of the transactions and provide any further documents or information we require within the time periods required;
- all actions, proceedings, liabilities, claims, loss, damages and reasonable costs and expenses (including all legal or professional fees) which may be taken against us or which we may suffer, sustain or incur howsoever arising out of or in connection with inappropriate, misuse or unauthorized use of your TNG Mastercard or TNG Wallet.
12.Disclaimer of Liability
We cannot guarantee a merchant will accept your TNG Mastercard, or that we will authorize any particular transaction. We have the rights to cancel or suspend the use of your TNG Mastercard with or without prior notice or reasons, to the extent permitted under the relevant law. Unless otherwise required by applicable law, we shall not be liable for any direct or indirect loss or damage you may suffer as a result of your total or partial use or inability to use your Card, or the use of your Card by any third party. We will also not be liable for any losses or expenses incurred by you arising from our compliance with legal and regulatory requirements and we will not be liable to you for (1) any loss of goodwill, reputation or opportunity, (2) any loss or corruption of data, (3) any loss of anticipated savings in connection with your failure to use your TNG Mastercard due to whatever cause, whether direct or indirect, and (4) any indirect or consequential loss. In the event that you do not use your TNG Mastercard in accordance with these Terms and Conditions or if we find that you are using the TNG Mastercard fraudulently, We reserve the right to charge you for any reasonable costs that we incur in taking action to stop you from using your TNG Mastercard and to recover any monies owed as a result of your activities.
13.Amendments
Subject to the applicable laws, we may at any time change or remove any of the Terms and Conditions of, or add new terms or conditions to, these Terms and Conditions. We will post such changes on our website at https://www.tngwallet.hk/en/legal/terms-of-use/card/Mastercard. As of the effective date included in any notice, the changed or new terms will apply to the TNG Mastercard, including, without limitation, all transactions made using the TNG Mastercard after such effective date. Notwithstanding the foregoing, advance notice of any change may not be given if it is necessary to make any such change immediately in order to maintain or restore the security of the TNG Mastercard or any related payment system or comply with applicable law. We may, in our sole discretion, cancel or suspend these Terms and Conditions or any features or services of the TNG Subject to the applicable laws, we may at any time change or remove any of the Terms and Conditions of, or add new terms or conditions to, these Terms and Conditions. We will post such changes on our website at https://www.tngwallet.hk/en/legal/terms-of-use/card/Mastercard. As of the effective date included in any notice, the changed or new terms will apply to the TNG Mastercard, including, without limitation, all transactions made using the TNG Mastercard after such effective date. Notwithstanding the foregoing, advance notice of any change may not be given if it is necessary to make any such change immediately in order to maintain or restore the security of the TNG Mastercard or any related payment system or comply with applicable law. We may, in our sole discretion, cancel or suspend these Terms and Conditions or any features or services of the TNG
If we notify you of any changes to our Terms and Conditions in accordance with any applicable law and you keep or use the TNG Mastercard, you are taken to have agreed to the changes.
14.Personal data protection and data collection
We maintain a privacy policy (“Privacy Policy”) and a data collection policy (“Data Collection Policy”) in handling the personal data collected from our client from time to time. The Privacy Policy and the Data Collection Policy are available at our website and form part of these Terms and Conditions.
15.Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong. You and we irrevocably submit to the exclusive jurisdiction of the courts of Hong Kong.
Should there be any discrepancy between the English version and the Chinese version of these Terms and Conditions, the English version shall prevail.
16.Rights of Third Parties
These Terms and Conditions shall not create or give rise to, nor shall it be intended to create or give rise to, any third party rights. No third party shall have any right to enforce or rely on any provision of these Terms and Conditions of which confers or may confer any right or benefit on any third party, directly or indirectly, expressly or impliedly. The application of any legislation giving rise to or conferring on third parties contractual or other rights (including, but not limited to, the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the laws of Hong Kong) in connection with these Terms and Conditions is hereby expressly excluded.
